The United States Courts of Appeals are facing a crisis. The number of cases filed has skyrocketed in recent years, while the number of judges has remained the same. This has led to a backlog of cases and long delays in getting decisions.

In 2021, the Courts of Appeals received over 70,000 new cases, a 10% increase from the previous year. The median time it took for a case to be decided increased from 9.5 months in 2015 to 12.3 months in 2021.

The crisis is having a real impact on the justice system. Delays in getting decisions mean that parties to lawsuits are waiting longer for their cases to be resolved. This can lead to financial hardship and emotional distress.

There are a number of factors that have contributed to the crisis in the Courts of Appeals.

  • Increase in the number of cases filed. The number of cases filed in the Courts of Appeals has increased steadily over the past decade. This is due in part to the increase in the number of lawsuits being filed in the United States.
  • Lack of new judges. The number of judges in the Courts of Appeals has not kept pace with the increase in the number of cases filed. This is due in part to the fact that it is a lengthy and difficult process to appoint new judges.
  • Complex cases. The cases that are being filed in the Courts of Appeals are becoming increasingly complex. This is due in part to the fact that the law is becoming more complex.

There are a number of possible solutions to the crisis in the Courts of Appeals.

  • Increase the number of judges. The simplest solution to the crisis would be to increase the number of judges in the Courts of Appeals. This would help to reduce the backlog of cases and speed up the decision-making process.
  • Streamline the appointment process. The process of appointing new judges is lengthy and difficult. Streamlining this process would help to speed up the appointment of new judges and reduce the backlog of cases.
  • Simplify the law. The law is becoming increasingly complex. Simplifying the law would help to reduce the time it takes to decide cases.

The crisis in the Courts of Appeals is a serious problem that is having a real impact on the justice system. There are a number of possible solutions to the crisis, but it is important to find a solution that is both effective and fair.
